Legal Blanket for the Movie Star
Last week, I was disgusted to read a headline that said a taxi driver was holding nude photos of a famous actress (let’s call her “Ms. Dem”). Apparently, he and a partner hired a taxi to take them to a certain airport. According to the article, they forgot their camera in the cab and now the driver is seeking large sums of money to return it or otherwise.
Where is the world going? I miss something here. I guess he didn’t know who his passengers were so he searched the contents of the camera hoping to identify the owners. Wasn’t searching for the content of the idea just returning the product to the owner? Then again, maybe he knew who his passengers were.
Last year I flew from Paris to St. Maarten. An hour later I got a connecting flight to Antigua for the cricket final. For those who don’t know, Antigua is part of the twin island nation of Antigua/Barbuda – two jewels of 80,000 inhabitants in the Caribbean Ocean. Most know the destination as a place where the rich and famous and the local population have interacted and lived in comfort for the past 50 years. True: hundreds of celebrities have summer, winter and permanent homes there, but it hasn’t lost its natural charm or “world famous taxi driver hospitality/honesty”. During the tournament, it was not unusual to hear the announcers asking the person in the cab who left this gear to go to location x and bring some form of ID.
I operated a luxury wholesale travel agency on the island for years. My duties included taking care of top travelers. Some wanted helicopter tours to neighboring islands: the most requested were tours of the Montserrat volcano and a tour of Barbuda, Antigua’s sister island, to the world’s largest frigatebird sanctuary. My last stint before starting my current radio role was routing 200 passengers weekly during the winter seasons to 10 luxury hotels. They arrived for a week and during that time 90% wanted to discover as many of Antigua’s nearly 400 beaches as possible. It never failed. Although I would try to get them to the airport on time to avoid the traffic, there were always latecomers on the day of departure who had the same story: “We don’t want to leave.” In that dark and tense pre-flight space, many people forget things.
The taxi drivers knew we were charter flights. On average, drivers called me six to ten times a month. “I just got back to the hotel; the last passenger I brought there left —- in my taxi. Taxi driver so and so, car number so and so just left for the airport and I gave the stuff to him or her.” I called the tower and the drill began: tower to the captain and vice versa. The captain announced, and sure enough the passenger was on board. Some would request that the product be shipped to the company’s Boston office. Others asked how long it would take and many times we heard that the flight was on the taxiway and it would take. It was everyday.
Of course I questioned a few older taxi drivers. Do people still leave cameras and briefcases in your taxi? “Every week” was the answer. None of the drivers I interviewed knew what to do. In Antigua, about 2,000 people are registered drivers who belong to about five taxi associations. Three of these have an exclusive contract with the restaurant industry. I don’t know if it’s because of the pride they take in customer service – a well-known marketing fact, but they take great pride in their relationship with their customers. They get stripes when repeat travelers ask for them by name, and every year “their repeats” bring them gifts: from baseball caps to the latest electronic gadgets. It is not unusual to see guests having breakfast, lunch or drinks at the homes of their “favorite drivers”. I bring you this information to understand the extreme shock, rage and anger those guys expressed when I showed them the article. “IT CAN’T HAPPEN YA.” “He’ll throw you out immediately.” It needs no explanation: automatic rejection, mockery and bad reference. If this happened to one of their drivers he would be ashamed and the shame would be too much to bear.
Service providers in the restaurant industry act as virtual ambassadors. Taxi drivers fall into this category. When individuals order a taxi to take them from destination A to B, the driver is expected to transport passengers and all their belongings safely. In Antigua/Barbuda, all taxi drivers must be members of an official taxi association. They sign the protocol and have special conditions. All tour operators contract with them on the understanding that they will adhere to these principles. Often guests have left cameras, wallets and luggage. Many vigilant drivers check before leaving; Some make discoveries only after returning to their base. We have not only delayed flights, but also cruise ship departures to return items. Once we got a tugboat captain to return a movie camera to a cruise ship.
The driver of the cab knowing what was on the camera means one of two things:
1. He checked the contents to try to identify the possible owner.
2. He suspected who the owner/owners were and tried to be curious.
Whatever the motive, in most tourist destinations the driver has one option – to return the product cycle. Selling information is grand theft for two reasons:
1. He breached the implied contract between the traveling contractor and the passenger.
2. He stole his passengers’ private vacation memories.
Courts can accept different types of contracts: express and implied. In these two types, the injured parties can seek compensation from the courts. Am I to assume that since the passenger is a celebrity and his personal property has more value than John’s, are the rules different?
