Sex Offenders in Your Neighborhood – Would You Prefer Residential Restrictions Or GPS Monitoring?

My experience with sex offender residency laws is limited to Miami-Dade County, FL laws and the cities within the county’s borders. Each state, city, and community has developed different laws and therefore has different experiences with enforcing those laws. Therefore, please do not take my statement as written in stone. I ask the reader to take my experience and match it with their own. Perhaps by doing this and creating a discussion, a unified solution to this problem can be found.

The main problem with sex offenders in Miami-Dade is that they basically fall into two categories: 1. The person is on probation, meets with a probation officer who checks on their whereabouts and compliance with the terms of their probation. 2. The subject has completed his time and must report his address to the sheriff’s office four times a year (Miami-Dade County has a police department). The Police will check addresses from time to time and ensure that they comply with laws and regulations.

The problem with the second category is that a sex offender can provide a false address to comply with the law or pretend to be homeless so they can live anywhere. There’s really no way for the police to prove that a person isn’t living at an address, or that they aren’t actually homeless. A sex offender can have a house right across the street from a school or playground, pretend to be homeless, and go about his life. Just because he’s in the house doesn’t mean he lives there. The police would be forced to have the police watch my address and prove that you have been at the address for as long as you are legally required to have lived at the address. Also remember that you can own a house and not live in it. Even sex offenders on probation will sleep at a different location given as an address and then return to their house after the curfew ends (most sex offender curfews in Florida are between 10:00 PM and 6:00 AM, so you’re free to move around then , when the children start school).

Another problem with residence restrictions is the so-called pooling phenomenon. Certain communities will be far enough away from schools and parks to emerge as legitimate places for sex offenders. All sex offenders start moving there or hoarding there. Then the community is flooded with sex offenders. The usual response is to create laws that force sex offenders to move to another community and integrate. The action is simply repeated over cities and counties. Many sex offenders then simply disappear, while others simply declare themselves homeless and live wherever they want.

My answer to closing the loopholes listed above would be to replace residency restrictions with GPS tracking. This would give police, victims and communities real-time information about the whereabouts of sex offenders day and night. GPS monitors allow the police to know the exact location of sex offenders at any time of the day or night. It would allow the police to find out where the offender actually lives and if he is violating a no-shoot zone around schools or daycare centers. Best of all, when an offender cuts his belt, the police are immediately alerted and know the general location of the sex offender when the incident occurred and they arrest him or send a BOLO (Be On The Look Out) . This would be much more effective than waiting for the sex offender to register.

Additional benefits include the ability of the device to notify victims, schools, day care centers, etc. if a sex offender is within so many feet of their property. This would allow staff to be more vigilant in protecting the children in their care and to alert the police if there is a problem. This knowledge will provide real security to the community instead of the lip service that is being offered now.

Now for the down side… Costs! These units are not cheap and need to be serviced. Many are injured, lost or destroyed. Police also require officers or staff to monitor the location of sex offenders and respond to alarms. However, these costs must be weighed against the costs of molesting another child. That decision should be made by community leaders and legislators.

If a community decides to use GPS monitoring, I recommend that the community lift all residency restrictions and adopt an outreach campaign to inform residents of who the sex offenders in their community are and where they live. Knowledge is the best defense. Residents also need to know what sexual offense the person was arrested for, not charged. There can be a big difference between why a person is arrested and what they are charged with. This arrest information allows residents to find out what sex offender is in their neighborhood (remember, the sex offender in your neighborhood could be a 35-year-old man who had a 15-year-old girlfriend when he just turned 18 he is 16 in another week and is now married to the victim who has two children in a marriage of 10. If you knew this information about this sex offender you would treat him much differently than if you knew the offender molested a 5 year old boy. ).

A final additional benefit would be that the offender could find a place to live and perhaps learn to reintegrate into society. A man with something to lose is much more controllable than a man with nothing. These settlement laws continually put these offenders in a position where nothing will cause many to re-offend. Even worse is when the offender decides that he was better off in prison and decides Have fun before we go back. Definitely a situation we don’t want.

Legislators must decide whether they want public safety against sex offenders or really give their citizens and police the tools they need to actually monitor the population. Knowledge is the key to this, not ignorance and fear. Knowing what you know now, would you rather be told where they can’t live or know who and where they are? Which one would you feel safer with?
